Charges

The conditions and tariffs for reproductions are detailed in the Ministerial Decree of September 2nd, 2011 (Moniteur Belge/Belgisch Staatsblad/Belgian Official Journal of September 23th 2011). This decree modifies the decree of May 25th, 2009 that fixes the tariffs for services delivered by the National Archives and State Archives in the Provinces. The restrictions apply to all types of document reproductions, be they carried out by the State Archives or by the reader in person.

Which documents may be reproduced?

  • Public documents, for which an authorisation is required for use and reproduction;
  • Documents that are not the property of the State Archives but for which a written authorisation from the owner (depositor) is required prior to any reproduction;
  • Documents that are exempt from any copyrights;
  • Documents that contain personal data, for which a written authorisation is required from the competent authority prior to any reproduction;
  • Documents that do not represent a significant part of an archive group (a collection, section, series or sub-group).
Obviously, it is not possible to obtain reproductions of documents that cannot be consulted due to their poor physical condition.

What use can be made of a copy?

All copies, even those made with a personal camera, are exclusively reserved for private use. “Private use” means that the permission to produce a copy and the right of use shall not under any circumstances grant the right to publish, communicate or transfer these copies to a third party.
If a copy is intended for a publication or commercial use, the rights of use will apply in conformity with the above-mentioned charges.

What types of copies can be made?

You will be able to make your own photocopies of microfilms using the reader-printer. If an archive employee is required to make a copy for you, this will be considered as a written order.
For reproductions that have to be made by the staff, please ask the manager of the reading room. You will be provided with information concerning colour scanning and the possibility of having pictures taken by a professional photographer.

The original documents are scanned by the staff using a scanner that is suitable for archive documents. The restrictions that were necessary when photocopies were made no longer apply and almost all documents can now be scanned. However, it is forbidden to reproduce documents that are not public, in an excessively poor condition or subject to copyrights.
These copies may be provided in digital or printed format. If you opt for the digital version, the scanned document is sent via a server from which it can be downloaded using the Internet. You will receive a URL address and a password in order to download the images. If you would like a printed copy on paper (similar to a photocopy), you will be able to print it out yourself using a PC in the reading room.
The charge for printed copies using the reader-printer and scanned documents must be paid using a Xafax payment card. If scanned copies need to be posted, the necessary payment must be made in cash.
In most cases, the order will be completed on the same day. The times when these transactions can be completed will be displayed on the notice board. If it is not possible to complete the order immediately, you will be informed of the time when the scan will be available. The scanned document can be obtained on your next visit or it can be sent to you by e-mail or by post within two weeks.

It is permitted to make copies with a personal camera, but it is necessary to complete and sign in advance the declaration concerning the taking of photographs, which is available from the reading room employee. The following conditions are included in this declaration:
  • The equipment must not come into contact with the document (portable scanners and hand-held scanners are forbidden)
  • The use of flashes and any other additional lighting is not authorised
  • The document must not be larger than the desk
  • The photographed document must be placed on a reading table, lectern or special cushion provided for this purpose
  • Tripods can only be used if this does not cause any damage to the documents or to the desk.
